Terms of Service
Last Updated: June 11, 2026
1. Agreement to Terms
Welcome to Viallo! These Terms of Service ("Terms") govern your access to and use of the Viallo website and related services (collectively, the "Service"). The Service is operated by Zava Solutions LLC ("Viallo," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
2. Eligibility
You must meet the following requirements to use the Service:
- You must be at least 13 years old (or 16 in the EEA)
- You must be able to form a binding contract under applicable law
- You must not be prohibited from using the Service under any applicable laws
- You must provide accurate and complete registration information
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Account Registration and Security
3.1 Account Creation
To use certain features of the Service, you must create an account. You may register:
- With an email address and password
- Through Google Sign-In
- Through Apple Sign-In
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Ensuring your account information is accurate and up-to-date
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, illegal activity, or any other reason at our sole discretion. You may delete your account at any time through your account settings.
4. Description of Service
Viallo is a private photo sharing platform that allows you to:
- Upload, store, and organize photos in albums
- Automatically organize photos by location using GPS data extracted from your photos
- View your photos on interactive maps
- Share albums privately with family and friends through secure, shareable links
- Share albums directly with other Viallo users
- Control access to your photos with optional password protection
- Access your albums from any device
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
5. Photo Time Capsule storage commitment
When you create a Photo Time Capsule and choose a delivery date between 1 and 50 years from upload, Viallo enters into a contract with you to store the encrypted capsule and deliver it on that date. The lawful basis under GDPR Article 6(1)(b) is contract necessity — storage and processing are required to perform the agreement you accept by sealing the capsule.
For deliveries 1 to 5 years away, we commit to keeping the capsule until that date.
For deliveries 6 to 15 years away, we commit to keeping the capsule until that date and we will check in with you annually around your selected anniversary, in line with the operational schedule in our Privacy Policy.
For deliveries 16 to 50 years away, by the time we deliver this back, you and the world will be different. We commit to keeping this for you that long, as best we can. Material risks that could prevent delivery — Viallo's insolvency, a regulatory order to cease operation, or a force-majeure loss of the underlying storage infrastructure — are not within our absolute control; in those events, you remain entitled to a current export of the encrypted capsule for as long as it is recoverable, and we will provide notice via the email on file.
You can cancel a sealed capsule at any time before its delivery date, and you can delete it from your account at any time after delivery. Cancellation and deletion are explained in our Privacy Policy; deletion destroys the per-capsule encryption key within 30 days, after which the encrypted blob is mathematically unreadable to anyone, including Viallo.
Viallo's commitment to multi-decade retention is given in good faith, on a best-effort basis under the contract you accept by sealing. This commitment is not a representation of perpetual or unconditional availability beyond what is operationally and legally possible at any given time.
6. Subscription Plans and Payments
6.1 Subscription Tiers
We offer the following subscription plans:
- Free Plan: Up to 2 albums, 200 photos, 10 GB storage, 3 share links
- Plus Plan ($5.99/month or $59/year): Up to 20 albums, 5,000 photos, 200 GB storage, unlimited share links, password-protected sharing, basic analytics, user-based sharing (up to 10 users)
- Pro Plan ($14.99/month or $149/year): Unlimited albums and photos, 1 TB storage, advanced analytics, profile sharing, unlimited user-based sharing, bulk operations, export features
Paid plan subscribers may also purchase storage add-ons for additional capacity. Available add-ons and pricing are listed on our Pricing page.
Prices are in USD. We reserve the right to modify plans and pricing with 30 days' notice.
6.2 Payment Processing
Subscriptions purchased on our website are processed securely through Stripe. By subscribing to a paid plan on the web, you authorize us to charge your payment method on a recurring basis. You agree to provide accurate payment information and update it as needed. Subscriptions purchased through our iOS app are processed by Apple and billed to your Apple App Store account — see section 6.7, which governs those purchases.
6.3 Billing and Renewal
- Subscriptions automatically renew unless cancelled before the renewal date
- You will be charged at the beginning of each billing cycle
- We may change subscription prices with 30 days' notice
- Price changes do not affect current billing cycles
6.4 Cancellation and Refunds
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of the current billing period
- Except as required by law, paid subscription periods — including partial billing periods — are non-refundable
- If you are a consumer in the EU or EEA, you have a 14-day right of withdrawal on subscriptions purchased on our website (see section 6.5)
- Refunds for subscriptions purchased through the Apple App Store are handled by Apple (see section 6.7)
- Upon cancellation, you retain access until the end of the paid period
- After cancellation, your account reverts to the free plan with applicable limitations
6.5 EU/EEA Consumers — 14-Day Right of Withdrawal
If you are a consumer resident in the European Union or the European Economic Area, you have the right to withdraw from a subscription purchased on our website within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract is concluded.
Because Viallo provides digital access immediately, you expressly request, when you subscribe, that we begin performance during the withdrawal period. If you then withdraw, you are liable for an amount proportionate to the service provided up to the moment you inform us of your withdrawal (counted per started day), in comparison with the full subscription. We refund the remainder of the amount you paid to your original payment method without undue delay.
To exercise the right of withdrawal, you may either:
- In your account, go to Settings → Subscription and select Withdraw from contract, then Confirm withdrawal; or
- Send us an unequivocal statement of your decision to withdraw by email to info@zava-solutions.com. You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. We will acknowledge receipt of your withdrawal by email without undue delay.

Name of consumer(s): __________
Address of consumer(s): __________
Signature of consumer(s) (only if this form is notified on paper): __________
Date: __________
The in-account withdrawal function and the procedure above apply to subscriptions purchased on our website. If you purchased your subscription through the Apple App Store, refunds and any withdrawal are handled by Apple under Apple's policies — see section 6.7.
6.6 Failed Payments
If a payment fails, we will attempt to process it again. If payment continues to fail, we may suspend or downgrade your account to the free plan.
6.7 Purchases Through the Apple App Store
If you subscribe through our iOS app, your purchase is processed by Apple and billed to your Apple App Store account rather than through Stripe. For these purchases, the following terms apply in place of sections 6.2 through 6.4:
- Payment is charged to your Apple App Store account when you confirm the purchase.
- Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- You can manage your subscription, turn off auto-renewal, or cancel at any time in your device's App Store subscription settings.
- If a free trial is offered, it converts automatically to a paid subscription unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Refunds for App Store purchases are handled by Apple in accordance with Apple's policies, not by Viallo.
7. User Content and Intellectual Property
7.1 Your Content
You retain all ownership rights to the content you upload to the Service, including photos, text, and other materials ("User Content"). By uploading User Content, you grant us a limited license to:
- Store, process, and display your User Content
- Make your User Content available to people you choose to share with
- Create backups and derivative works necessary to provide the Service
- Extract and store metadata (EXIF data) from your photos for organizational purposes
- Generate thumbnails and optimized versions for better performance
Important: We do not use your photos for advertising, marketing, or any purpose other than providing the Service to you.
This license ends when you delete your User Content or account. Note that content you have shared may have been viewed or saved by recipients before deletion, which is outside our control.
7.2 Photo Metadata
When you upload photos, we automatically extract embedded metadata (EXIF data) including:
- GPS coordinates and location information
- Date and time the photo was taken
- Camera make, model, and settings
This data helps organize your albums and display photos on maps. If you do not want this information stored, you may remove EXIF data from photos before uploading using third-party tools.
7.3 Content Restrictions
You agree not to upload User Content that:
- Violates any law or regulation
- Infringes on intellectual property rights of others
- Contains viruses, malware, or harmful code
- Is defamatory, obscene, pornographic, or offensive
- Promotes violence, discrimination, or illegal activities
- Violates the privacy or publicity rights of others
- Contains personal information of minors without parental consent
7.4 Content Monitoring and Removal
We reserve the right (but have no obligation) to monitor, review, and remove User Content that violates these Terms. We may remove content without notice and at our sole discretion.
7.5 Our Intellectual Property
The Service, including its design, features, code, and trademarks, is owned by Viallo and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
8. Sharing and Privacy
8.1 Album Sharing
When you share an album:
- Recipients can view all content within that album (unless you hide specific photos)
- You are responsible for managing who has access
- You can revoke access at any time
- Recipients must respect any sharing permissions and restrictions you set, and must not attempt to bypass them
8.2 Share Links
You can create shareable links to your albums with the following features:
- Public Links: Anyone with the link can view your album
- Password Protection: Require a password to access (Plus and Pro plans)
- Analytics: View statistics about who accessed your shared links (Plus and Pro plans)
- Hidden Photos: Exclude specific photos from shared views
You are responsible for keeping share links secure. If a link is compromised, you should revoke it immediately.
8.3 Share Link Analytics
We collect analytics about shared link access. For Plus and Pro subscribers, we make these analytics available, which may include:
- Number of views and unique visitors
- Access dates and times
- Device types and browsers used (derived from the user agent string)
- A pseudonymous visitor fingerprint used to estimate unique visitors (derived from the visitor's IP address and user agent)
- A limited access log containing recent access timestamps and technical metadata (which may include IP address and user agent)
This data helps you understand how your content is being accessed and may help protect the Service from abuse. Access logs are limited (for example, to the most recent 1,000 entries per share link) and may be visible to the album owner. These analytics are not intended to identify viewers by name or email.
8.4 User-Based Sharing
You can share albums directly with other Viallo users by their email address. Recipients will receive notifications and can access shared albums through their account.
8.5 Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
8.6 Profile Sharing
Depending on your subscription plan, you may be able to share your profile (which may include multiple albums) with other Viallo users. You are responsible for selecting who can access your profile and for managing permissions, included or excluded albums, and revoking access.
9. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Violate any applicable laws or regulations
- Impersonate any person or entity
